Terms of Service

1. The service

Khwaza Radio, operated by Khwaza Media, provides internet radio stream hosting (ShoutCast / Icecast), AutoDJ and a listener web player. Features and limits depend on your plan.

2. Your account

You must provide a valid email address, be at least 18 (or have a guardian's consent), and keep your login details secure. You are responsible for all activity on your account and stations. One free station is permitted per verified email address; creating multiple accounts to obtain extra free stations is not allowed.

3. Acceptable use

Your use of the service must comply with our Acceptable Use Policy. In short: broadcast only content you are licensed to transmit, nothing unlawful, and do not disrupt the service or other customers.

4. Music licensing

You are solely responsible for obtaining and paying for all licences required to broadcast your content in every territory where your station can be received — in South Africa this typically includes SAMRO, SAMPRA and CAPASSO. We do not provide music licences.

5. Free stations

Free stations are provided "as is". A free station that has no source connection for a prolonged period (see your dashboard for current thresholds) may be suspended, and later removed together with its data, to keep the network healthy. We will email you before this happens.

6. Paid plans, billing and refunds

Paid plans are billed monthly in advance in South African Rand. If a renewal payment fails we may suspend the station after a grace period and terminate it if payment is not brought up to date. You can cancel at any time from your dashboard; cancellation takes effect at the end of the paid period and we do not provide pro-rata refunds for partial months, except where required by the Consumer Protection Act.

7. Suspension and termination

We may suspend or terminate any account or station that breaches these Terms or the Acceptable Use Policy, that is used unlawfully, or that poses a security or stability risk. Where practical we will give notice and an opportunity to fix the problem. You may close your account at any time; on termination your stations and stored media are deleted.

8. Copyright complaints

We respond to valid copyright complaints and repeat-infringer accounts may be terminated. See our Copyright & Takedown page.

9. Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance, upstream provider issues, or events beyond our control may cause downtime.

10. Liability

To the maximum extent permitted by law, the service is provided without warranties, and Khwaza Media is not liable for indirect or consequential loss (including lost listeners, revenue or data). Nothing in these Terms limits liability that cannot be limited under South African law, including under the Consumer Protection Act.

11. Changes

We may update these Terms. Material changes will be notified by email and posted here with a new date. Continuing to use the service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction.
